Résumé d'une décision sur la validité d'une hypothèque légale de la construction sur un centre d’épuration d’eau
Dans la décision Pointe-Claire (Ville de) c. Service & Construction Mobile ltée, 2010 QCCS 6201 (CanLII) { https://canlii.ca/t/2dz6t }, le Tribunal a statué que, bien que le litige portait sur des réservoirs de carburant municipaux, ces installations, indispensables à la prestation de services publics et à la communauté, étaient « appropriées à l’utilité publique » au sens de l’art. 916 C.c.Q., de sorte qu’aucune hypothèque légale de la construction ne pouvait y être inscrite :
[9] The Court is satisfied that the entire legal issue is resolved by applying the reasoning of Mr. Justice Paul Chaput in Société générale de construction PBF inc. which this Court adopts. Particularly in an area such as this, it is important for there to be consistency in judicial interpretation to provide certainty in the law. Greater certainty allows the parties to better order their affaires by ensuring sufficient performance bonds that protect sub-contractors on municipal projects. As Justice Chaput noted, the Court of Appeal applied a liberal interpretation as well as the French theory of “accessoires” to art. 916 C.C.Q. to find that a storage facility – for sand and salt used on municipal streets and located on municipal property – was “… established in the public interest and is appropriated to public utility”.
[10] The evidence in the present case is comparable. The various municipal vehicles using the City’s fuel reservoirs are used to provide the following municipal services: public works, engineering and water treatment, horticulture, finances, fire, public security and recreation. As municipal vehicles are necessary accessories for municipal public servants to provide these municipal services, it is logical that the on-site storage reservoirs for the fuel necessary to power these vehicles is also an accessory included within art. 916 C.C.Q. as being “… established in the public interest that is appropriated to public utility”.
[11] There is no evidence whatsoever that these fuel reservoirs and their contents are used for anything other than services to benefit the municipality’s citizens. For these reasons and despite the able argument of the sub-contractor’s counsel, the City’s action must be granted in accordance to its conclusions since the exemption under art. 916 C.C.Q. applies.
